Legal Aid is available in appropriate cases.
We have extensive experience in this area .We can advise on all aspects of law arising from a breakdown of family relationships such as legal separation, maintenance, divorce and the division of property and assets .The firm deals regularly with cases involving Residence (which decide with which parent a child should live after a separation) and Contact ( which decide what level of contact a child should have with the non-resident parent). Our principal solicitor has had widespread involvement and a specialist interest over many years in dealing with Care Proceedings. These involve situations where a Health Trust is seeking to place a child in Care and we have legally represented the interests of mothers, fathers and indeed of children themselves in cases heard in the Family Proceedings Court, Family Care Centre and High Court. Our firm also deals with cases involving adoption whether that adoption is by consent (eg by a step-parent) or when it is opposed and a Trust is seeking to “free” a child for adoption against the wishes of one or both parents.
If you have entered into a Civil Partnership and now wish to dissolve it then we can make the necessary application to Court and deal with any financial issues arising from the dissolution including property distribution and pension rights.
We also deal with cases involving domestic violence and can obtain a Non-Molestation Order against the offending party, on an emergency (what is called an “ex parte”) basis, if necessary, through an application in private before the District Judge and at a subsequent full hearing.
Wills, Probate and Administration of Estates
Making a Will is something which many people, understandably, tend to put off doing but it is the only way to ensure that after your death your assets go to exactly whom you want them to go. Failure to make a valid Will leads to what is called an Intestacy and when that arises certain automatic legal provisions will apply which dictate which family members will inherit under the deceased person’s estate. This can often mean that your savings, property and assets will end up being distributed amongst people whom you would not have intended to benefit in the event of your death. We therefore always recommend that our clients consult us so we can discuss with them the making of a Will which properly reflects their wishes. They can then be secure in the knowledge that their hard-earned assets will only be inherited by those people they intended.
On death, our firm provides a full Probate and Administration of Estates service .We will guide the personal representatives through the legal procedures involved in taking out a Grant of Probate (in the case where the deceased made a Will) or what is called a Grant of Letters of Administration Intestate (in cases where no Will was made). There are certain tax forms to be completed whether or not Inheritance Tax is payable and we will advise on the completion of those.
Conveyancing/House Purchases & Sales
The firm is a member of the Law Society of Northern Ireland Home Charter Scheme, which will give you the security and peace of mind of knowing that strict quality controls and procedures are applied to every case where we deal with the purchase and/ or sale of a domestic property for you. From the beginning of the process to the end we will guide you through the various stages involved and always in clear terms, both in face-to face interviews and in written communications to you. It is our aim to make the whole experience of buying and selling a house as straightforward and unstressful as possible. We provide a written Quotation for Domestic Conveyancing Charges in all cases so you can see at the outset what the estimated professional fees and outlays involved will be.
If you have been arrested and taken to a police station for interview or have been asked to attend there for interview on a voluntary basis or if you have been charged with a criminal offence and need to appear in court then our firm will arrange representation for you at both the interview stage and at any subsequent court appearances. Proper legal representation at trial and knowledge of your rights at interview stage are vital in criminal cases. We will explain to you and advise you on the likely outcome of your case and are committed to obtaining for you the best result at all times.
